1. Scope of Services

E & B Express Courier, LLC ("EBX Couriers," "we," "us," or "our") provides specialized medical courier services for the transportation of medical devices, specimens, pharmaceuticals, and related healthcare materials ("Medical Materials") throughout the Gulf South Region.

2. Regulatory Compliance

2.1 HIPAA Compliance

EBX Couriers operates as a Business Associate under the Health Insurance Portability and Accountability Act (HIPAA) and maintains compliance with all applicable regulations regarding Protected Health Information (PHI).

• All drivers and personnel are HIPAA trained and certified
• Chain of custody documentation is maintained for all deliveries
• Data encryption and secure communication protocols are enforced
• Business Associate Agreements (BAAs) are executed with all healthcare clients

2.2 DOT and State Regulations

We comply with all Department of Transportation (DOT) regulations and Louisiana state laws governing the transportation of medical materials.

3. Client Responsibilities

3.1 Packaging Requirements

Clients are responsible for ensuring all Medical Materials are properly packaged and labeled according to applicable regulations, including:

• Biohazard materials must be in leak-proof, properly marked containers
• Temperature-sensitive items must be in appropriate thermal containers
• All packages must include necessary documentation and labeling
• Hazardous materials must comply with DOT regulations

3.2 Accurate Information

Clients must provide accurate pickup and delivery addresses, contact information, and special handling instructions. EBX Couriers is not liable for delays or failed deliveries resulting from inaccurate client-provided information.

4. Service Levels and Timing

4.1 STAT Deliveries

STAT deliveries are prioritized for urgent medical situations. While we make every effort to meet target delivery times, actual delivery times may vary due to traffic, weather, or other factors beyond our control.

4.2 Scheduled Deliveries

Same-day and scheduled deliveries are fulfilled during normal business hours unless otherwise arranged. Delivery windows may vary by ±2 hours from scheduled time.

5. Pricing and Payment

5.1 Service Fees

Pricing is based on distance, urgency level, special handling requirements, and current fuel costs. Rates are provided upon request submission and must be accepted before service dispatch.

5.2 Payment Terms

Payment is due upon delivery for individual orders unless a billing agreement has been established. Net 30 terms are available for qualified healthcare facilities with approved credit applications.

5.3 Additional Charges

Additional fees may apply for:

• After-hours pickups or deliveries (weekends, holidays, after 6 PM)
• Failed delivery attempts due to recipient unavailability
• Extended wait times exceeding 15 minutes at pickup or delivery locations
• Special handling requirements not disclosed at time of booking

6. Liability and Insurance

6.1 Limitation of Liability

EBX Couriers maintains comprehensive commercial auto insurance and general liability coverage. Our maximum liability for loss, damage, or delay of any shipment is limited to $1,000 per package unless additional insurance is purchased at time of booking.

6.2 Exclusions

EBX Couriers is not liable for:

• Consequential or indirect damages
• Loss or damage resulting from improper packaging by the client
• Delays caused by acts of God, severe weather, civil unrest, or other force majeure events
• Contents not disclosed to EBX Couriers at time of pickup

7. Claims Procedure

Claims for loss, damage, or delay must be submitted in writing within 30 days of delivery date (or expected delivery date for lost items). Claims should include:

• Tracking number and delivery receipt
• Description of loss or damage
• Documentation of value (invoice, purchase receipt, etc.)
• Photographs of damage, if applicable

8. Privacy and Data Protection

All personal and health information is handled in accordance with our Privacy Policy and HIPAA regulations. We maintain strict confidentiality protocols and do not share client information with third parties except as required by law or to fulfill delivery services.

9. Prohibited Items

EBX Couriers does not transport:

• Controlled substances (Schedule I or II narcotics) unless specifically authorized and documented
• Explosives or flammable materials outside of approved medical use
• Currency, jewelry, or high-value non-medical items
• Live animals (except service animals accompanying clients)
• Any items prohibited by federal or state law

10. Cancellation Policy

10.1 Client Cancellations

Cancellations made more than 30 minutes before scheduled pickup receive full refund. Cancellations within 30 minutes may incur a 50% cancellation fee. No refunds for cancellations after driver has been dispatched.

10.2 EBX Couriers Cancellations

We reserve the right to refuse service or cancel deliveries if we determine that safety, regulatory compliance, or operational feasibility is compromised. Full refund will be provided in such cases.

11. Term and Termination

These Terms remain in effect for each individual transaction or for the duration of any ongoing service agreement. Either party may terminate ongoing service agreements with 30 days written notice.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Louisiana without regard to conflict of law principles.

12.2 Arbitration

Any disputes arising from these Terms or services provided shall be resolved through binding arbitration in Jefferson Parish, Louisiana, in accordance with the American Arbitration Association rules.

13. Modifications

EBX Couriers reserves the right to modify these Terms at any time. Updated terms will be posted on our website with the effective date. Continued use of our services after modifications constitutes acceptance of updated terms.
